Wholesale Broadband Agreement Consultation September 2011

NBN Co has released the fourth edition of its Wholesale Broadband Agreement for consideration by the industry. The WBA will be the contractual vehicle NBN Co will use to supply all of its products and services to its customers and will have the regulatory purpose of "declaring" NBN Co's services as required by our legislation.

In releasing the WBA, NBN Co wishes to provide its customers with a further opportunity to consider and discuss with NBN Co the substance of the documents prior to publication as a Standard Form of Access Agreement in the coming weeks.

The documents released include the core terms and conditions of the WBA, the Product Catalogue, Credit Policy and Product Development Forum Processes. Also released is the Product Technical Specification underpinning NBN Co's Fibre Access Service, Operations Manual and the details of NBN Co's transitional CVC pricing offer.  Where appropriate and possible, documents have been made available in both clean and marked up form to assist readers readily identify the nature of the changes introduced since the last round of discussion.

NBN Co has also provided an "NBN Co Response" information paper that is intended to provide an insight into the views of customers on particular issues and the position NBN Co has taken in response.

It is NBN Co's intention to continue to meet with customers wishing to engage on the latest draft of the WBA prior to publishing a Standard Form of Access Agreement.  As part of this engagement, NBN Co will assess the requirements of the industry to move from trial to more certain commercial arrangements ahead of scaled network deployment, and inform its decisions about its next steps on the basis of the views expressed by both industry and the ACCC. 

NBN Co once again thanks all industry participants who have contributed to what has been a beneficial consultative process.
