Acceptable Use Terms and Privacy Statement
By accessing the Indirect Worker ID Administration Portal (Indirect Worker ID Administration Portal) and/or the Digital Products Portal (Digital Products Portal) (each, a Portal), You agree to these Terms of Use ( Terms) between You and NBN Co Limited (nbn).
Under these terms:
- "You" means an "SDP", an "SDP Delegated Administrator" and an "Indirect Worker" as defined below;
- You are an SDP if you are a contractor of nbn;
- You are an SDP Delegated Administrator if you are appointed by an SDP to be an authorised administrator of your SDP's Indirect Workers' access to the Digital Products Portal and have been provided appropriate credentials from nbn; and
- You are an Indirect Worker if You have been authorised by an SDP (in accordance with the processes in the Indirect Worker ID Administration Portal to access the Digital Products Portal in your capacity as an employee, individual contractor or contractor of the SDP or a sub-contractor (or employee or individual contractor of a sub-contractor) of the SDP, and have been issued with an "Indirect Worker ID", and password and/or such other access credentials as are required by nbn from time to time (Access Credentials).
nbn permits You:
- if You are an SDP or an SDP Delegated Administrator to access the Indirect Worker ID Administration Portal for the sole purpose of performing the contract between nbn and You or Your employer for the purpose of building or operating the National Broadband Network (SDP Contract); or
- if You are an Indirect Worker, to access the Digital Products Portal using the Access Credentials issued to You for the sole purpose of building or operating the National Broadband Network and of performing the SDP Contract between Your employer and nbn or Your employer and the SDP ( SDP Sub-Contract),
(the "Permitted Purpose").
You may not access or use any data, information, mobile application ("App") or material on the Portals, or otherwise obtained or accessed by You in connection with Your use of the Portals ("Portal Data"), other than for the Permitted Purpose, and must treat all Portal Data and these Terms as nbn's confidential information.
nbn may at any time:
- vary or replace these Terms by updating this page, and You agree that You must regularly review these Terms to ensure You understand and comply with the current version of these Terms; or
- terminate these Terms by providing notice to You.
Your right to access a Portal under these Terms ceases immediately if You cease to be a SDP, a SDP Delegated Administrator or an Indirect Worker or You are no longer required to access the Indirect Worker ID Administration Portal to perform Your role as a SDP, a SDP Delegated Administrator, or the Digital Products Portal to perform Your role as an Indirect Worker.
You must immediately cease accessing the Indirect Worker ID Administration Portalor the Digital Products Portal (as applicable) and permanently delete any Portal Data from any personal and/or mobile devices that You own or control if:
- these Terms are terminated by nbn providing notice to You; or
- You are no longer required to access the Indirect Worker ID Administration Portal to perform Your role as an SDP, an SDP Delegated Administrator, or the Digital Products Portal to perform Your role as an Indirect Worker.
Apps downloaded or installed from the Portals may be subject to additional terms and conditions specific to that App.
Intellectual property rights
You acknowledge that the Portals and Portal Data are protected by copyright or other intellectual property rights owned by either nbn or nbn's licensors. You agree to comply with any applicable third party terms notified by nbn to You from time to time (including where notified to You via the relevant Portal).
You assign to nbn ownership in any intellectual property rights created by You in connection with Your use of the Portals or Portal Data.
Liability and indemnity
To the maximum extent permitted by law: nbn disclaims all express and implied warranties with respect to the Portals; nbn provides access to the Portals and Portal Data to You 'as is'; and nbn is not liable to You in connection with Your use of the Portal or Portal Data.
Privacy
You must not collect any personal information in connection with Your use of a Portal unless nbn agrees You may do so.
If You collect any personal information in connection with Your use of a Portal, You acknowledge and agree that You collect such information as agent for nbn, and must collect, use, handle and disclose such personal information for the Permitted Purpose and in compliance with the Privacy Act 1988 (Cth) and nbn's Privacy Policy (available at www.nbnco.com.au/privacy).
If nbn provides You with any personal information in connection with Your use of the Portals (including information relating to the owner or occupier of a premises), You must only use, handle and disclose such information for the Permitted Purpose in compliance with the Privacy Act 1988 (Cth) and nbn's Privacy Policy (available at www.nbnco.com.au/privacy).
When You use a Portal, You acknowledge that:
- Personal information about You may be collected from You or an SDP (if you are an Indirect Worker) and used and disclosed for purposes related to the function and purpose of the Portals and/or the construction or operation of the National Broadband Network. As part of this, nbn may also require copies of identification documents for the purposes of verifying Your identity. If You do not provide the information requested, nbn will not be able to provide You with access to the Portals. The organisations that nbn typically discloses this type of information to may include nbn contractors and other nbn related service providers and where we are required to do so by an Australian law or a court/tribunal order.
- The nbn Privacy Policy (available at www.nbnco.com.au/privacy) contains information about how You can make a complaint about a breach of the Australian Privacy Principles and how nbn will deal with such a complaint. If You wish to access, correct or update Your personal information You can do so at any time by logging into the Digtial Products Portal or through the Indirect Worker ID Administration Portal via your administrator. You can contact nbn via Your administrator. If you are an Indirect Worker, Your SDP will have the contact details for that administrator.
General
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia.
